Truck Was Smashed Into!

My Neighbor side swiped my truck at 2am last night and did a nice chunk of damage. I was wondering befor i talk to the insurance company this morning am i intitled to a rental equal to my truck since i have a camping trip planed this weekend and need to tow my TT. Anyone else ever in a situation like this. I think we both have the same insurance company ERIE

ouch, not sure if you are going to luck out on this one, but good luck, i had a neighbor do a similar thing, I let him off easy and did not report it and let him just pay for my repairs...... other wise i get the feeling he would have don a lot of walking and bike riding for 6 months to a year.

2A.M.? Sounds alcohol related. I'd contact the insurance company asap. Your neighbor will wake up and see damage to your truck and his. If he was drunk, he won't remember what happened, and think you did it.

when my old chevy got smashed into at work they gave me another truck i told em ineeded it for work so i got it they also had warenty work done to my 05 dodge and they gave me a 1/2 ton gasser cuase i told em i needed one so they told me i could not tow with it but i put a ball on it anyway just dont tell em your towing they dont like that just make it clear you HAFTO HAVE ONE and you should get it Good luck man sorry about your truck

well its turned into the insurance companys and i should here from his on tuesday. he knows what he did and said he wasent drinking. i also have the right to demand all new parts when they fix my truck to right? thanks for the help and hopefully ill get a truck for a rental. ill post pics!

Ouch, on the truck. I know here in Texas you can rent pick up trucks specificly for towing. Check around and you might be able to rent one, with the other insurance company picking up the tab.

and this is a lil dead end road about 700-800 feet with 5 houses on it and he did that much damage

Not drinking HUH ??? Then what had his attention since it obviously wasn't the road.
As for your rights, your pretty much up to the mercy of his ins. co. unless you turn it over to yours and have them go after his co.
I had $12,000 in damage to my truck back in 06 and the other guys ins. company wanted to give me $13,000 for the truck and take it. I told them to shove it up there not nice place and that there was no way they would get my truck for less than bluebook. I called my insuarnce company and they told me that there was 12,000 in damages. I asked them if they were gonna total it. They said, "no way...the truck is worth $28,000. I have Progressive and they use the Dealer Retail value of NADA. They put a lil over 12,000 into it and went after Allstate. They got their money and I got my deductable back. Also.....In your case it won't matter much, but in my case I told the body shop what parts I was gonna buy. I ended up with the SRT style fiberglass hood, aftermarket painted grill, projector beam headlights, aftermarket bumper cover, and a used intercooler I picked up from here. I walked away from the body shop with a BETTER looking truck AND money in my pocket.

It looks like that with a new front tire your truck is drivable. Do the weekend trip and then send it to the body shop.

Theres a 2 inch gap in the seal at the top of the back door i got plastic taped on the truck now cause it rained tonight. i got the passenger door open but im affraid to try the back door. and with that gap i really dont want to go on a trip with the truck.

Sorry to say it - but if there was that much damage, I would have called the police. When you indicated "sideswiped" then promptly dove into how much you have to rent a similar truck (secondary issue here) I suspected it was a minor parking-lot fender bender. THIS IS NOT MINOR DAMAGE.

I would be the last to want to call the police on this situation, but this is a serious accident, with two valuable veichles, at a pretty suspicious time of night. I would also say the rental is the least of your worries right now. Good luck with this mess - sorry that it happened.
