I'd like to know how they could charge him with ANY M/V violation. The incident took place in a private, gated community in which the public does NOT have a right of access. Like citing someone for speeding in their own driveway.

Probably similar to rules here. May be gated and although "private", but he does not own the road like you do your driveway, just has deeded access. Unless it's closed to commercial deliveries/contractors, etc., reckless/careless owi are enforceable. Speed is arbitrary, so long as the driver is being safe. ALL crashes involving INJURY are to be reported regardless of public/private/vehicle type (quads/snowmobiles too).

Unless that gated community is drastically different than what we had in Mass, the HOA owns all the infrastructure; roads, water, sewer, electrical, etc.
What Don says, "ALL crashes involving INJURY are to be reported regardless of public/private/vehicle type (quads/snowmobiles too)", makes sense. But we had a gated community that the only thing we would enforce was domestic violence type incidents. Or if someone intentionally ran down someone with a M/V of course. But routine accidents where the parties involved refused medical treatment were not 'investigated' per se, unless something intentional took place. Basically, if the public didn't have a common right of access to it, we weren't worried about it either.

We wouldn't take property damage accidents either.
As an example, my road is private/deede access (just don't have money or want a gate). I don't own the road but have a right to be on it. When me and my mother are walking the dogs and the idiot neighbor comes roaring past us with the wheel in one hand and a beer in the other without slowing down or moving over a safe distance, reckless and or harsher is very enforcable, even though there is no enforcable speed limit.
Anyway you dice it, Tiger just finally got what was coming to him. Hope his wife makes out like a bandit.
