my truck bought from a dealer was WRECKED?! lawyers?
ive just noticed that the rear pass. side door on my truck has been bondo'd and the mirror on the driver side has been replaced. looking underneath, there are several grease pencil markings on hte frame and overspray on the gas tank! i still need to run carfax, but i am pretty sure this truck has been wrecked. i bought it used from the dealer 2 years ago, but paid quite a bit for it as it was when the new style was fairly new. when i bought it, it was late at night and they could not find the keyless fobs or owners manual. they also gave it to me on empty. they told me to come back the next day for fuel and the other stuff. upon returning, they gave me the run around and i just took it as typical dealer stuff and left town for several weeks and never thought much about it. i know its been 2 years and ive built a totally custom suspension, BUT had i known it was in a wreck i obviously could have had some bargaining leverage when i negotiated a price. i dont expect them to take it back, i dont really know WHAT i want, but im HEATED now. ill check out carfax tomorrow. is this just a lesson learned or do i have any recourse? i paid almost 40k for it with 10k miles in late 04, obviously too much, but this dealership has a long history of screwing ppl like this come to find out. any thoughts? lawyers? thanks

Looks like a nice truck to me. I suppose I would be a little mad to but the dealership probably won't do anything for you now. They may not have known about it either, maybe question them about it. It would be hard not to look at that ride and not smile right?

If you had discovered it in the first, let's say, 30 to 90 days, it might have been a different story. You're 2 years down the road now, so that works against you. I guess if you want to pursue it, you should consult an attorney and let him give you his thoughts regarding your chances of success.

Way past any statute of limitations, IMHO. Besides, all of the defects you just mentioned were things you could have & should have noticed when you bought the truck. They were not "hidden". Nothing you mention effects the performance or driveability, only the value of the truck. After 2 years there is no recourse because you have no loss, you have not been harmed.
Save your money and skip the CARFAX. They are worthless.
Just drive it and love it.

if that carfax comes back sayin it was hit before you bought it, you may stand a chance, if not, it's your word against theirs on when the repairs occoured. they could claim that you had the repairs done after buying the truck. Hope this makes you feel better : that is one hella nice looking truck, man what a lift kit does for a ride

Sixguns is right, the dealer may not have noticed it. It is your decision as to how handle the situation at this point. But in my opionion, along with the others in here, thats one SWEET ride!

other than a door that might have been dented, what does it effect? Is it really worth the trouble?
Sure there is always the principle of the matter...

On something like this, the statute of limitations may not start until he became aware of the defects. Might be worth checking into. As far as his "should have known, it was visible", he's not a body man, and they repaired the vehicle. In this case, he's a consumer that's been misled.

I've heard of several cases of people finding prior unreported damage on vehicles they bought . A guy bought a new Mercedes in AL and later found out it had been repainted . He sued and the jury awarded him $4 million in punitive damages but it was reduced to $2 million after Mercedes appealed . At Clarkhoward.com message boards a guy found out his new Honda had been rear ended and repaired before he bought it . There were several posts on this in the Cars and Ripoffs forums . The dealer finally negotiated a settlement with a nondisclosure clause so he can't tell what the settlement was . If the Carfax shows the damage you have a case but GA and other states have a regulation saying if the damage was less than 5% of the value of the vehicle the dealer doesn't have to disclose it . Here's the response to that situation . http://clarkhoward.com/p/boards/ch/s...psed&sb=5&vc=1 .

rockittboy,
Way past statute of limitations, sounds like you're outta luck on an otherwise sweet ride. Also, off topic, but I see you have a RC51 Honda. I've been in the market for one of those for a while now. What do you like on that compared to your CBR1000?

Don't feel to bad buddy, I think it's those California dealers. Folsom Lake Dodge in Sacramento got me also. Im in the EXACT same boat as you are.
I got my truck almost 2 years ago. I made the mistake of picking it up at night also. I checked the truck out in the day also but didn't quite notice this until several months after the purchase.
When I bought my truck it already had a 5th wheel hook up in the back, that was all fine and dandy. Well I eventually spoted a small dent/crease near the top of the roof right above the rear window on the passanger side. I thought no big deal it must of got bumped somehow. Well as time went on I noticed a very small leak in the rear window(during heavy heavy rain, and it only did it once) so I naturally looked around all of the seals and noticed that right behind the rear seats on the lower portion of the glass there was a recent date, signifying a instalation of a new window. I put two and two together and came to the conclusion that some idiot who had the truck before me jackknifed their 5th wheel, causing the dent and knocking out or shattering the window.
I shurgged it off but was still a little P.O.'ed. Well get your boots on boys cause it gets deeper. My panel on the bed(right above the rear wheel well on the passanger side) has this runny overspray paint that you can only see if your looking at an angle. Im guessing they must of damaged that panel realy bad and tried covering it by applying a (edit) paint job to it.
When I consulted the dealer they claimed of never knowing about it, B.S. I realy didn't pursue the situation any more because I was in the process of moving out of state. The truck runs fine, and you realy have to look hard to notice these things.
Next time I purchase a vehicle im expecting it with a magnafying glass.

My father bought a new 1973 Chevy Cheyenne Super 10, the best package Chevy offered in 1973.
A few weeks after purchase, it was noticed that the left front fender was a few shades different color than the rest of the truck.
The dealer offered to color-match the fender without a hint of argument.
The attempt at matching turned out no better than before, and was just as noticable.
Several months later, quite by accident, we found out that the truck had almost fallen off the ramps of the transport trailer, while being unloaded at the dealership where we got it.
The left fender had to be replaced with a new one, along with a few other parts.
It's just like when they drop the meat for your sandwich on the floor ; what you don't see from the drive-thru won't hurt you.
