Noise bylaws
My neighbours have "suggested" that they are going to petition against my truck (which is straight piped) in order to get a bylaw officer down to check out how many decibals I'm putting out. Does anyone know if they can do this or not? the british columbia MVA says internal combustion engine...do diesels fall under this classification? It also mentions that anything added to make more noise is prohibited...not taken off.
Muffler
7.03 (1) A motor vehicle propelled by an internal combustion engine shall be equipped with an exhaust muffler consisting of a series of pipes or chambers which ensures that the exhaust gases from the engine are cooled and expelled without excessive noise.
Cut-outs prohibited
(2) No person shall drive or operate a motor vehicle propelled by an internal combustion engine when the muffler with which the vehicle is equipped is cut out or disconnected from the engine.
Part removal prohibited
(3) No person shall drive or operate a motor vehicle propelled by an internal combustion engine equipped with a muffler from which has been removed any baffle plate or other part.
Alteration prohibited
(4) No person shall drive or operate a motor vehicle propelled by an internal combustion engine equipped with a muffler the exhaust outlet of which has been opened or widened.
Noise increase or flames prohibited
(5) No person shall drive or operate a motor vehicle propelled by an internal combustion engine equipped with a muffler or exhaust system to which is attached any device which increases the noise of the expulsion of the gases from the engine or allows a flame to be emitted from the exhaust system
Also, does anyone know the factory decibal rating?

The opinion of an inspector as to whether the engine and exhaust noise is greater than that made by other vehicles in good condition of comparable size, horsepower, piston displacement or compression ratio shall determine whether exhaust gases are expelled with excessive noise.
When tested in an inspection station, the vehicle engine, any auxiliary engine and exhaust level shall not exceed Table 3 standards.

I think you're gonna have to put a muffler on it to make the neighbors happy.
#2 pretty much nails you to the wall, #3 keeps you from putting in a dummy muffler, #4 seems like it would make a 4" exhaust technically illegal.
I would try to avoid having to bring it to an inspector. You gotta comply with the 83 dB rating unless Canada defines "heavy duty" different than the U.S. That's gonna be hard to do even with a stock muffler what with all the noise the VP44 makes.

I feel sorry for you....if my neighbors pulled a stunt like that then Andy would not be happy!
I may even consider moving.....just so I dont have to live around tree huggers.....and keep my exhaust on.

the stupid thing is, is that I never hammer on it when I'm in the neighbourhood. its almost always at (*EDIT*1200-1300rpm, checked this afternoon) 1500 rpm. i live in a culdesac, so I guess the sound really reverberates, but even still...i agree with derek and andy...oh well. I'll just have to get my 4" a bit sooner

Call me old but I am on the neighbors side. Some turds around here have their exhausts hacked off and I really don't appreciate the noise at 5am. I wouldn't be as nice as getting the noise police after you. Better not come live here.

In my defence, i haven't "hacked off" my exhaust. I just replaced some components. If I were leaving at 5am i would understand the dilemma they have, but my truck starts up at 610am, when most others (who have gainful employment) get up anyway. and you can stick the attitude too. I fully respect my neighbours and I don't rip around the neighbourhood like an idiot. we have young kids where I am, so I pretty much idle in and out of there. no one is asking for you to "side" with anyone. I was simply wondering if I fell within the law the way I have my exhaust and if my neighbours had a right to call in the bylaw officer.

You have already quoted the law so now you have overcome the ignorance of it, a bylaw officer is not needed the RCMP can charge with removing required OEM components under the safety code. The RCMP must also act on a filed complaint, expect to see more of this in our quiet communities. However make a note of all vehicles and their plate numbers, description and date to defend the action as not being the only one in non-compliance. Good luck as removal of the muffler is not required to produce power enhancements but simply an irritant creating unnecessary noise. PK
