Here's how the state of Texas defines a muffler:

http://www.txdps.state.tx.us/vi/insp...ejectsubmit=Go

"Muffler defined: Muffler is a device consisting of a series of chambers or baffle plates or other mechanical design for the purpose of receiving exhaust gas from an internal combustion engine and/or turbine wheels for the purpose of receiving exhaust gas from a diesel engine, both of which are effective in reducing noise."

Here's another quote pertaining to diesel emission systems:

http://www.txdps.state.tx.us/vi/insp...ejectsubmit=Go

"NOTE: The inspection of the exhaust emission system shall not apply to motor vehicles altered and modified to use only a fuel other than gasoline."

And one more:

http://www.txdps.state.tx.us/vi/insp.../item_insp.asp

"Diesel powered vehicles and motorcycles are exempt from emissions testing, but are still required to have the annual safety inspection"

Federal law may supersceed state law, but when you get your vehicle inspected in Texas, they will be using the state of Texas guidelines to inspect the vehicle. So in reality, federal law doesn't supersceed state law in this case.
Good research , but , do me a favor , call the the feds , tell them your name , address , phone number ETC, then inform them that you have removed your stock exhaust in favor of one with no catalytic converter , and no muffler. Let me know the results

I don't know if you've read this thread or not, but not one person has said anything about removing a catalytic converter. This thread has nothing to do with catalytic converters. The title is "Is no MUFFLER legal in Texas?" No mention of catalytic converters. The answer according to the state of Texas inspection website is YES, IT IS LEGAL NOT TO HAVE A MUFFLER BECAUSE THE STATE OF TEXAS CLASSIFIES A TURBO AS A MUFFLER.

My truck came from the factory without a cat. Do you have a phone number for the "feds" so I can call them??

Internet? What's that?

I ask because if someone has done the research, has found legitimate info and will share that info then me doing the research is unnecessary work.

Thanks very much for the post. It's not the "law" per se, just the State's instructions to MVI inspectors, but at least it gives me something to work with.

Fed guidelines = worthless. Never heard of a federal police officer out making traffic stops so fed guidelines don't amount to squat. State police & local police don't enforce federal guidelines either so I guess fed guidelines are a moot point.

Really I just have a pint of Scottish ale riding on that question and I can muddy the waters enough with it for me to win.........

You can also get a ticket for disturbing the peace because your exhaust is supposed to be under 85 decibles and with a str8 pipe you will well exceed that.
85db is a presumptive measure --------ahh, too long to get into on a UBB board. Not many po-po carry a decibel meter either.......

Off the subj. a little but i heard tonight that in dallas they are going to start pulling diesels over for excessive black smoke and they give you a time limit to take you truck to the dealer and have them flash your comp and give you an inspection to show the judge you did it. Then the second time you have to do the same but they wont dismiss it, and so on..
