Well, those laws have changed quite abit, cauz ive been pulled over by dot and they have inspected my fuel tanks, technically speaking that doc pertains to dot vehicles, your not supposed to be carrying more then you can use in one day, and not more then 40 gallons, I suspect thats the reasoning behind a 35gal fuel tank factory in our trucks, yes years ago you could get larger factory tanks, the laws have changed.the doc you showed is from 1996....Im only repeating what ive been told by dot officers ive spoken too.
I have too say many times the laws can and will be interpreted in many different ways, by different branchs of leo's, where I live there is the sherrif, highway patrol, local pd's, state troopers, and dot. They all have their own versions of what you can and cant do.I have many friends who have been ticketed. Nothing however will trump federal dot laws. The tank must be dot approved and plumbed correctly to avoid being put out of service.

That tank looks small for 75 gal.
I m going to put the cover like you, just got one from eBay
and finally all done well not 100 % but system is usable , all is left to vent the factory tank it gets under pressure when pump transfers the fuel so I need to vent the tank , pump works excellent and pumps fast, little noisy but it is ok

MY point is make sure your setup is dot approved or you'll be on the side of the road with a heavy fine, also they have limits as to how much you can transport, you will need a cdl with hazmat and fuel carrier permit if you exceed that limit. there is also a proper way of tieing that tank into your system to meet dot specs.

Just went through something like this at work. A few times a year we have to haul 200 gal. tanks of pesticide. Federal Law states you must have a Tanker endorsement if transporting more than 119 gal, unless it is the fuel supply/reserve of the vehicle.
