Deleted 2012 mega and sold on cl now guy who bought says he is calling epa

I deleted my 2012 Mega Cab 6.7l , egr and dpf with a race me tuner. I sold it on Craigslist and took pictures under hood and the delete pipe under and listed on eBay an cl that it was deleted and the improvements since the delete.

Guy buys said truck with 32k miles knowing deletes are in as even on test drive I showed him the tuner and he noticed the difference.

Its been over a month and the guy calls me and asks for the egr and dpf that came off truck, I told him I sold on eBay..

Now he says he is calling the epa and turning me in since I won't give him or buy new stock egr / dpf items.

What's your thoughts on this situation.

Well, he can do whatever he likes, but he did purchase it as it was presented to him, and subsequently accepted the responsibility for doing so.

You only drove the truck ..... off road.... right ????

Now he bought a "off road modified vehicle" and he's using "on road " Right ????

Well, since HE owns the truck HE's responsible since "HE" purchased the truck "AS-IS".

You buy a defective rifle, and it blows up on your face because you decided to use it, vs hang it above your fireplace, then that's your problem.

He's the owner, it's his reponsibility to return it to stock to utilize it on the street...... Just like he "TOLD YOU" when he bought it, he was going to do..

NJT has pretty much outlined your only "good" option. I say "good" instead of good because it is still not a great way to go forward. Assuming the new owner goes through with it, how comfortable are you at lying to gub'mint officials?

Was it illegal to delete the truck when you did it? If not then there is not much ground he can stand on. As mentioned you can assume to have only used it off road or as a farm truck. For him to hire a lawyer would cost as much for him to replace everything. Don't let a letter from an lawyer worry you either. Keep records of the cl ad and eBay add as well. Good luck.

Yes; it has been illegal to delete any vehicle with emission equipment installed on a vehicle. It has been this way since the early 1970's when users of gas power cars were removing the catalytic converter and installing test pipes on them.

Even as they drove away I asked if they wanted the stock stuff, they said they were just buying the truck to sell at auction and it would sell no matter what.

Then a full month later they call very nice and ask if I still had them that they would take them, I told them that they need to speak with the ex wife she has them at the house she got, along with the cash from the truck. Like normal she said for $1500 you can have the stock stuff or give the programmer and deletes and she will give the stock items back.

That's when they got all but hurt, now its every hour

relax, remember that anyone can sue for anything.

72 hours from his physical ownership of the vehicle, the return factor of legal claim ends. ebay is generally an 'as is/ where is' format.

Buyer went outside of ebay for a claim, that tells me he may have pushed the facts off to the left for any real problem.

you have nothing to worry about. if he is in your state, and you think he will continue this line of thinking- send a First Class letter AND certified return receipt letter to his address of record (info he gave you or Ebay) informing him that his conduct if harassing and causing you worry and to stop. (cease and desist) any further contact you get to file a report with YOUR local sheriff. Protects you from facebook defamation, classified ad, ect.

up to you, but no Courtroom is in your future.....

once Order of Protection is in place, his contact with you will now cost him 1500 bucks for each offense. then criminal conduct afterwards...

only you can tell how wacky he will get.... hope that helps Big Sky man.

He's blowing smoke.... (pardon the pun). He has no real recourse unless you put something in writing guaranteeing him something. In NJ, he would be following the same rules applied above. 72 hours, and it's his, and nothing he can do about it. He'll find very quickly how expensive it will be, and what a pain in the butt it will become for him to actually prove anything against you. He bought a truck "as is" and that's exactly what it means. He accepted responsibility when he walked away, and no amount of buyer's remorse will help him now.

Yeah, he's being a bully, I'd say. Block his phone number and his email address. If he keeps bothering, call the police for harassment. Turn it back around on him.

I would love to know the dealer as I live right in your backyard. I can guess too though with a pretty good idea.

BTW, Heidi had a great post but I'm not sure Craig's list and eBay have the same terms. I thought you sold it on Craig's but the delete stuff on eBay. All the same, her advice on getting a protection order is awesome.

Also, Montana has no checks or enforcement in place for emissions. They don't follow CARB or EPA. Not sure if that matters or not being a federal mandate. The federal mandate is usually in place so the manufacturer can sell the vehicle in all 50 states (extortion) then it's up to the state to enforce it or not.

ignore this guy. He must have run into a problem with EPA checks when he went to get it licensed. Why would that be your problem? "as-is" means "as-is", not change it as you see fit when buying said item.
