Seized Wastegate?

Seized Wastegate?
I have a 2006 Dodge 2500 Cummins bone stock with 104k on it... My CEL has been coming on under hard acceleration for the last year. The error code comes back as a engine/turbo overboost. I had a mechanic change out linkage connected to the wastegate which he thought would fix the problem. It did not fix the issue. I just now got around to taking the truck to a different mechanic and he is saying the wastegate is seized and that I need a new turbo. The truck runs great and I have no problem with power at all. Am I doing damage to the motor by running the truck with this problem? Also would this problem have been covered under the cummins 100k warranty if I had caught the true issue sooner? Any help is greatly appreciated

it would have been covered under the warranty. it does not hurt the motor. but what will happen is the turbo will fail and you will have to pull the inter-cooler and intake manifold and clean. the inter-cooler usually stops the metal from reaching the valves. the he351 has massive back pressure above 36 psi, this lowers your mpg. the he351 is not prone to stuck wast-gates, i would suspect the diaphragm or the hose going to it. pull it off and check it. you can pull the turbo in about 20 minutes with a minimum of tools

it could be the electrically controlled solenoid that opens the wastegate is bad. its the black cylinder shaped thing just below intake tube check the wires/harness for chafing and that the plug connection is clean. also check the vacuum hose that goes to wastegate linkage for cracks.
i have one of the solenoids off an old turbo that worked when i pulled it pm me if you need one.
