Im thinkin a 2 tank system with a dummy tank filled with regular pump diesel. have the other tank fill up through some hidin lil area like tail light lisence plate...something nifty like that. If it was something you did religiously.

who knows what the rules are for heavy trucking? i would think, since i am a police officer, that if you are stopped for speeding in your 3500 diesel rig that you use for ur personal use and they decide to dip your tank they are violating your 4th amendment rights by conducting an illegal search and siezure. with out probable cause they have no right to search your truck unless you permit them. now as far as big commercial rigs im not sure if just by the nature of there job and discription, they pay road tax that the normal person does not, that they wave this portion of there 4th amendment rights.

The IRS Code and the Code of Virginia (which piggy backs it )allows them to take samples.. As Junk Yard Dog says "handing him a piece of paper that has written "If you don't let us your screwed", The fine is something like $5,000.00 for EACH refusal to allow them test the tank... That is on top of the fine if they find dyed fuel

Because Congress believed that there was considerable evasion of this tax, the Omnibus Budget Reconciliation Act of 1993 changed some of the diesel tax procedures. Briefly, under the new procedures, the tax is levied on diesel fuel removed from a terminal's truck loading rack unless the fuel is dyed.
Dyed diesel fuel may be used only for nontaxable purposes. Anyone who knowingly sells or uses dyed diesel fuel for taxable purposes or who willfully alters the concentration of dye in diesel fuel is subject to a minimum $10 per gallon penalty. The 1993 Act gives the IRS authority to enforce the diesel fuel tax, including the authority to inspect terminals, dyes, dyeing equipment, and fuel storage facilities; and to stop, detain, and inspect vehicles.

Virginia has an entire section of Dept of Motor Vehicle Law Enforcement Officers that do dyed fuel inspections everyday.. Ever what these guys find, the IRS follows up with another bill, and whatever the IRS finds the state follows up with a fine..

As far as a dummy tank goes.. it may work.. BUT you never know who may be watching when you refuel.. That innocent looking van on the far corner of the parking lot could be agents watching who pumps off road fuel.. then they get your tag number and then you may have a visitor stop by for a chat (and a dip)..

I personally dont think its worth it.. Pay your tax.. its alot cheaper to pay VA and the Feds $0.404 a gallon in tax than pay a $10/gal (min $1,000.00) fine if (when) you are caught..
